What is Permanent Residency For EEA Nationals?

Permanent Residency For EEA nationals is for those who have lived in UK for 5 years continuously and exercised Treaty rights can apply for UK Permanent Residence Document. The Permanent Residency document confirms their right of permanent residence in UK. Those who are from EU, EEA or Switzerland can apply for Permanent Residency document and use the same to apply for British Citizenship and also to sponsor the visa application of their partners. The Permanent Residency document will not be valid beyond December 31, 2020. Those who want to continue living in UK after that date may apply to the EU Settlement Scheme.

Who can qualify for this?

A person qualifies to apply for UK Permanent Residency if he/she has been living in UK for minimum 5 years for working, studying, self-employed, self-sufficient or looking for work. The applicant can include close family members also in the application if they also qualify for UK Permanent Residency. The close family member can be spouse or civil partner, child or grandchild, parent or grandparent. Extended family members also can be included in the application if they were the applicant’s dependents or were members of his/her household before coming to UK and are still dependent on him/her or are still members of his/her household.

How to apply?

One can apply online for Permanent Residency for EEA Nationals. Those who apply online are required to make an appointment at a UKVCAS (UK Visa and Citizenship Application Services) service point where they have to provide their biometric information. Along with the online application they can upload the supporting documents also and have them scanned at the UKVCAS service point.

Those who are unable to apply online can download the form EEA (PR), fill up the same and send to the Home Office at the address given in the form along with supporting documents and £65 as fee.

Can you apply for British citizenship after getting an EEA permanent residency card?

Those who have lived in UK continuously for 5 years or more can apply for EEA Permanent Residency document. Those who have lived in UK for minimum 12 months after getting the EEA Permanent Residency document can apply for British Citizenship. They need the permanent residence document to prove that they have lived in UK for 5 years which can be any 5 year period.

Processing time

According to EU Law, applications for Permanent Residency for EEA nationals must be processed within 6 months. The funding cuts in various government departments had resulted in shortage of manpower and since the number of applications for EEA Permanent Residency is very high, longer time is taken to process the applications.
